Uninsured/Underinsured Claims vs. Liability Claims

When you are injured in a car wreck, and it was someone else’s fault, you have a claim against that person based on a theory of negligence. If the at-fault driver has liability insurance, you file a claim with his insurance company. If you are unable to resolve your claim with the at-fault driver’s insurance company, you file a lawsuit against the at-fault driver. His or her insurance company then has a contractual duty to defend them against your lawsuit.

  • Uninsured Motorist - Uninsured motorist claims are filed with your own insurance company. You still have to prove your injuries and present a claim for damages. In the case of an uninsured motorist claim, you may also have to prove that the other driver was uninsured.
